Harney Basin Critical Groundwater Area Rule Making – Oregon Water Resources Department

The Oregon Water Resources Department (OWRD) will amend rules that govern surface water and groundwater use and allocation within the Malheur Lake Administrative Basin. The amendment to the rules will designate portions of the Malheur Lake Basin Administrative Boundaries as a Critical Ground Water Area (CGWA) due to groundwater declines within the basin.

TLG is tasked to meaningfully engage, coordinate, time-manage and guide the Rules Advisory Committee towards goals identified for the rulemaking, while being mindful that rulemaking is a legal process where decision-making authority rests with OWRD and the Oregon Water Resources Commission. Through this process TLG is building relationships with all parties including farmers, special interest groups, law makers, and concerned citizens to bring their issues and concerns to the conversation with the goal of finding win-win solutions that will reduce water usage through phased curtailments, changing practice, water rights retirement, and the Conservation Reserve and Enhancement Program (CREP), while maintaining agriculture as a viable component of the regional economy.
